Terms and Conditions for the Durham University Catering App “DU Go”
These terms and conditions govern the download and use of the Durham University Catering App “DU Go” App (the App”). The App is owned and controlled by the University of Durham (the “University”) whose registered address is the Palatine Centre, Stockton Road, Durham, DH1 3LE. The App will be usable at the following University catering outlets:
(Singularly an “Outlet”, collectively the “Outlets”).
Subject always to contract and availability of products, the App offers customers using the Outlets the opportunity to use the App to participate in customer loyalty schemes, rewards, special promotions and prize draws (“App Promotions”) advertised and administered via the App. Additionally at the University’s discretion, the University may use the App to provide users with essential information about the Outlets, such as locations, opening times and menus and to allow customer feedback. The University reserves the right to develop the app to provide additional services such as payment and subscription services, subject to service specific additional user terms and conditions.
In the event that you as a customer wish to download the App and create a user account in order to access and participate in the App Promotions, you must visit an app store appropriate to your device and follow the online prompts.
Once the App has been downloaded and you have registered with a user account, you can follow the instructions set out on the App to use the App Promotions. By downloading the App and registering for a user account, you are deemed to have accepted and agreed to be legally bound by the terms and conditions set out herein. In particular, by placing an order, you agree as follows:
1. ALLERGENS AND DIETARY REQUIREMENTS: The University manages the control, content and provision of information regarding allergens in its products strictly in accordance with Durham University Food Allergens Policy which can be found here. You are advised that in the event you have any allergy, you should read this policy carefully and you should visit the Outlet you wish to use to discuss any specific dietary requirements with staff prior to placing any order. The Outlets do not directly use nuts in their products. However, some ingredients used in Outlet products may be produced in factories who handle or have handled nut products, and thus the University cannot guarantee its products to be completely nut free. You should be aware that some product items, or ingredients contained therein, may have previously been frozen. In addition, please note that although great care is taken in the preparation of all Outlet items, the University cannot guarantee that all bones have been removed from all meat and fish products and olives and other fruit may contain stones.
2. AVAILABILITY: You hereby understand and agree that acceptance and confirmation of any Outlet order by the University is not a guarantee that such order can be fulfilled. All items offered via Outlet Websites or the App are strictly subject to availability, and while every effort shall be made by the University to fulfil every order, in the event the University becomes aware that an item is no longer available following payment for your order, you shall be entitled to a refund of any charges applicable to any unavailable items. To arrange such a refund, please request that the team member serving you process a refund at the till at the point of collection.
3. PRODUCT DESCRIPTIONS: You understand and accept that many of the items offered on the App or Outlet menu are prepared to order and thus, although items are prepared following a prescribed formula, the appearance of food and beverages may vary from item to item and from time to time. All pictures and descriptions of items available for order, featured on the App or online menu are for illustrative purposes only and may not be an accurate representation of the food items you may receive.
4. PRICING: The University reserves the right to change the prices of items promoted via the App or Outlet Websites at any time, and prices may vary from time to time. The University endeavours to ensure at all times that the prices promoted for items via the App or Outlet Websites are correct at the point you place your order. However, in unlikely event a pricing error is identified by the University at any time, the University reserves the right to decline or cancel your order. You are then free to place another order when pricing errors have been rectified. The University accepts no responsibility or liability for any inconvenience caused in the event, or as a consequence, of any pricing error. All prices promoted via the App or Outlet Websites are inclusive of any applicable VAT.

6. CURRENT LOYALTY PROMOTIONS:
COLLECTABLE LOYALTY POINTS FOR APPLICATION AS A DISCOUNT: For each purchase of products from any of the Outlets, where purchases are logged via scanning the QR code on your App at the register/till at the time of purchase, the App will log loyalty discount points (“Points”) in the amount of three (3) Points every £1 spent. Each point collected shall be redeemable as a discount against future purchases at the rate of one (1) pence per Point. Where you wish to use your collected Points as a discount, you should notify the barista/register operator at the time of ordering. A minimum discount redeemable against any purchase is one hundred (100) points (£1). The maximum number of points redeemable against any purchase is thousand (1000) points (£10). BREW CLUB DRINKS LOYALTY SCHEME: For every barista made drink purchased at any Outlet, you can collect one ‘stamp’ applicable to the University’s ‘Brew Club’ loyalty scheme via the App or subject to continuation of the printed scheme, via a printed collection card. Upon collection and redemption of nine (9) ‘stamps’ one barista drink can be redeemed free. Note – free drinks specifically exclude Starbucks frappes.
7. DISCOUNT VOUCHERS: Discount Vouchers may be issued by the University against Outlet products on an adhoc basis at the discretion of the University. The terms and conditions for redemption of such vouchers will be stated alongside each voucher issued, including any time limitations on their validity and use. The University acting reasonably, reserves the absolute right to withdraw, discontinue or decline to honour any discount voucher issued, in the event it has been issued in error, contains mistakes or has been obtained via any misrepresentation or fraud
8. CHANGES, MODIFICATIONS TO THE APP AND WITHDRAWEL OF PROMOTIONS: The University may make changes to these Terms and Conditions, the App and including the modification or withdrawal of any App Promotion from time to time, for any reason, and without notice to you. Please check these Terms and Conditions, and any and all App Promotion specific terms and conditions stated or referenced within the App regularly to ensure that you understand the Terms and Conditions that apply at the time that you access and use the App or any of its features.
9. CANCELLATION OR WITHDRAWEL OF THE APP: The University reserves withdraw, restrict access to or terminate access to the App for any reason and without notice to you.
